The National Law Journal Names Fitzpatrick’s Justin Oliver to Second Annual List of Intellectual Property Trailblazers

WASHINGTON--(BUSINESS WIRE)--Justin Oliver, partner at Fitzpatrick, Cella, Harper & Scinto and head of the firm’s PTO Contested Proceedings practice, has been named one of only 50 Intellectual Property Trailblazers by The National Law Journal. The award celebrates the achievements of attorneys who are innovators playing a role in changing copyright, patent, trademark and licensing law.

Justin was honored for his role in spearheading an exhaustive study of final decisions at the Patent Trial and Appeal Board (PTAB). The firm’s now annual study showed that, while the PTAB was an amenable forum for challengers, it was not decimating patents at nearly the rate predicted. The National Law Journal highlighted the report’s findings that for some types of arguments, the PTAB actually had an invalidity record comparable to that of district courts. But for other arguments, the venues diverged. The National Law Journal emphasized that by spearheading the firm’s study, Justin took on a true leadership role in the IP community and combated fear over a landmark change in patent law with hard data.
