Jackson Kelly Attorney Eric Whytsell Elected to Governing Council of ABA’s Section of Public Contract Law

Jackson Kelly PLLC is pleased to announce that Eric Whytsell, a Member of the firm's Government Contracts and Investigations Team, has been elected to the governing Council of the American Bar Association (ABA) Section of Public Contract Law.

Whytsell is one of four new members elected at the ABA’s Annual Meeting in August to serve a three-year Council term, which began Sept. 1. The mission of the Section of Public Contract Law is to improve public procurement and grant law at the federal, state and local levels and promote the professional development of attorney and associate members in public procurement law. Whytsell also serves as co-chair of the Section’s State and Local Division, as well as vice-chair of the Section’s Subcontracting, Teaming and Strategic Alliances, and Intellectual Property committees. In addition, Whytsell is co-editor of the ABA’s 5th Edition Guide to Fixed-Price Supply Subcontract Terms and Conditions and a contributor to the ABA’s 2d Edition Guide to State Procurement: A 50-State Primer on Purchasing Laws, Processes and Procedures. Recently published by the ABA, the Fixed-Price Supply Guide provides a complete roadmap for drafting and negotiating subcontracts based on the terms and conditions of the Model Subcontract Form developed by the ABA Section of Public Contract Law’s Strategic Alliances, Teaming and Subcontracting Committee. The 50-State Guide, to be published in October, collects each state’s law, practices and procedures, and key issues in a single volume.

Whytsell represents clients on a full range of federal, state and local procurement matters. In addition to helping clients understand and assess the potential benefits and risks presented by government contracts, he advises on teaming, joint ventures and subcontracting arrangements and compliance with small business and socio-economic programs. He works closely with clients on contract negotiation and performance issues. In addition, he helps clients with bid and size protests; contractor and government claims involving changes, adjustments and terminations; internal investigations; responses to audits and suspension; and debarment issues.

In addition to his law practice, Whytsell frequently lectures and conducts training on federal procurement, contractor compliance, intellectual property rights in government contracts and export controls. He is a member of the National Association of College and University Attorneys, the National Contract Management Association, and the National Defense Industrial Association.

Whytsell received his Juris Doctor from the University of North Carolina at Chapel Hill and holds a Bachelor of Arts, cum laude, from Davidson College.
