The mixed-use Crescent Parke rezoning application vote will come before the council again this week after it was defeated during a July 26 meeting. Councilmember Bruce Gemmill is expected to make a motion for another vote after proffer changes swayed his decision.
Gemmill, along with council members Tom Dunn, Marty Martinez and Vice Mayor Kelly Burk were opposed during the first vote while Katie Hammler, Suzanne Fox and Mayor David Butler voted in favor of the application two weeks ago.
Vice Mayor Burk feels that without proper procedure, this vote and the proffer negotiations that proceeded it fail to provide transparency and violate the Freedom of Information Act.
“I think this is a process that is very unfair to the public," said Burk. “They came in and weighed in on the application and it was denied. Now the developer has met with certain individuals on council, what he has promised them, I have no idea. Maybe he's changed it and it's a much better application but it's a different application than we need to follow the process. If it's so wonderful then it should start the process again.”
